Our Terms & Conditions
By using this website you confirm your agreement
to our Terms and Conditions. Our Terms and Conditions may be subject
to change at any time without notification. These Terms &
Conditions shall be governed, and interpreted, in accordance with
Australian Law and Australian Courts shall have jurisdiction to
resolve any disputes between us.
We reserve the right to refuse any orders placed
by either our website, telephone or by mail order. Your receipt of
an electronic or other form of order confirmation does not signify
our acceptance of your order, nor does it constitute confirmation of
our offer to sell. We reserve the right at any time after receipt of
your order to accept or decline your order for any reason. We
reserve the right at any time after receipt of your order, without
prior notice to you, to supply less than the quantity you ordered of
any item. Ephonecards will assess a risk rating for all new users.
At its sole discretion, if the user is deemed to be of high risk,
Ephonecards reserves the right to refuse registration and right to
purchase.
By purchasing a Telephony product you also
confirm your agreement with the phone card provider's (our
suppliers’) Terms and Conditions. The Terms & Conditions and the
related supplier information for the phone card which you wish to
purchase should be reviewed by you prior to purchase. This
information can be found throughout the Ephonecards website or at
the phone card provider’s website.
Registration Verification
In order to provide our customers with the safest and most secure shopping experience possible we verify registration details by phone.
After your initial registration a representative will contact you during business hours to confirm your registration details. In the case that you are not available, five follow up calls will be made before contacting you by email.
After successful registration your phone card will be emailed to your registered email address. Where Ephonecards is unable to confirm the registration the account will be suspended until you can be contacted and registration details confirmed before any phone cards are sent to you.
Order Fulfillment
An order is deemed completed when we send you
the email containing the phone card information including its PIN.
This will normally be emailed to the email address given. The
purchaser should ensure that they give a valid, correct and active
email address. Examples of an invalid email address may include but
are not limited to:
a)
An email account that contains a deny filter on Ephonecards email
addresses
b) A
web based email address that has exceeded its capacity quota
c)
An inactive email address
In such circumstances we can resend the
purchasers order to another email address upon request. Details of
the phone card can also be obtained by logging into your account and
viewing the details online. Refunds are not granted by Ephonecards
under these circumstances.
We are not responsible for the non-receipt of
your card or email containing the phone card's PIN due to the
provision of an invalid or incorrect email address by you.
We do not accept postal orders.
Payment Terms
We accept postal orders, cashier’s cheques,
personal cheques, and company cheques in Australian dollars only.
Orders are processed upon receipt of cleared payment. Allow up to
six banking days after receipt of your cheques for personal and
company cheques funds to clear and before the order is processed. We
cannot guarantee the availability of a product by the time funds
clear or payment is received. We charge a $20 fee on all returned
cheques. Cheques should be made payable to "Ephonecards".
We accept payment for orders by direct deposit,
internet transfer or our securely hosted online credit card
processing facility. Credit card payments are processed in real time
by our Merchant Bank and only successful authorization shall be
subject to a sale. We cannot guarantee nor can we be held liable for
a decline of your credit card transaction. We cannot be held liable
for late confirmation of payment processing.
In any communications with ourselves you
undertake that all the details you provide to us are correct, that
the credit card you are using is your own and there are sufficient
funds to cover the cost of any purchases that you make.
We reserve the right to reject orders should we
at our sole discretion suspect that orders are not bona fide or are
fraudulent.

Any dispute on charges should be referred via
email to service@ephonecards.com.au
When using Direct Deposit you may have to wait as long as 3 days until the funds have been cleared by your bank and appear in our account. Please include your 9 digit Ephonecards Account Number in your transfer description or Reference so we know that the transfer is from you.
After the transfer, send an email to service@ephonecards.com.au telling us about the transfer with the receipt number if possible. Ephonecards will send the pin to your email after your funds have become visible in our bank account. This usually takes 3 - 4 days for your bank to process.
Refund or Exchange Policy
We practice a "No question asked" exchange and
refund policy. We will happily exchange a phone card with any other
equivalent value phone card of your choice as long as the original
card has a full balance. We can also offer a refund if you decide
not to exchange as long as the phone card has a full balance.
Partially used phone cards are not eligible for a guaranteed refund
or exchange.
Customers will be charged 75 cents for all refunds regardless of the cause for the refund.
No refund or replacement is provided for lost,
stolen or expired cards, unauthorised usage or should a phone card
provider (our supplier) cease trading.
Website Security, Fraud and Privacy Policy
You agree to provide us with the necessary
identification which may be required to confirm your order. We
reserve the right to not accept your order if you refuse to provide
us with the necessary identification.
We maintain a vigorous consumer protection
policy to fight fraudulent credit card users. Our transactions are
encrypted using Secure Server Link (SSL), the industry standard in
e-commerce protection. All attempts at fraud will be reported to the
appropriate authority or enforcement agency and we make available
our own private investigation service to aid the authorities or
solicitors or state police or attorney generals in their pursuit of
credit card thieves. It is normal practice that our staff are called
upon to manually inspect and verify all first-time orders or orders
that meet typical fraud profiles.
We reserve the right to pass over information to
the police and or any official body information that may help reduce
the use of fraudulent or unauthorized card use.
You agree to keep all emails (faxes or telephone
conversations) containing phone card details (including PIN numbers)
confidential. We shall not be liable for losses incurred by you as a
result of you disclosing such confidential information to any third
parties.
In the interest of security we do not store your
debit or credit card information electronically. We only store the
information required for our merchant account and required for
statutory reporting. This will include information that may be used
in the fraudulent use of debit or credit cards. Because of this we
will ask for your debit or credit card details for each order.
Your personal information may be stored and used
by us for research, marketing and update notification purposes but
under no circumstances will they be sold to any third party. If you
would like your email address removed from our records please notify
us at service@ephonecards.com.au
Minors under 16 years of age should not use the
services of Ephonecards without the supervision of a parent or
guardian. We rely on parents or guardians for their supervision as
we do not have any safeguard to prevent minors from visiting our
site.
Call Rates, Connection Fees and Surcharges
We endeavour to ensure that all information
available on our website is accurate. However, certain information
is subject to change. An example of this would be the rates for the
phone cards which may be altered by the relevant Card Providers at
their discretion and at anytime. We therefore, cannot guarantee the
accuracy of the information we provide, however, we monitor
information on an ongoing basis and update it on the website
accordingly. We do not represent or warrant that the Services
provided by the suppliers will be uninterrupted or error-free and
that defects will be corrected. Whilst we do spend time exercising
due-diligence in selecting our service providers, we are not
responsible for any losses or damages cause by errors of the card
providers.
Almost all phone cards providers reserve the
right to change their rates without prior notice. Ephonecards will
update our rate tables advertised on our web site when we receive
official notification about these changes. Updates will occur within
the next scheduled maintenance period. If you want to ensure that
the rates are the very latest and current, we recommend that you
check with the customer services number for the card in question,
prior to placing your order.
We do not accept liability for any errors or and
omissions, and reserve the right to change specifications,
information and description of listed products.
In some destination countries certain phone
numbers may carry additional charges, for example, mobile phone
numbers, national rate numbers, premium numbers and miscellaneous
other numbers. If in doubt please call the customer service
department of the card in question.
Rates may be rounded to the nearest minute or
cent depending upon denomination
Telephony Service Quality
Ephonecards are agents for the telephone cards
of our suppliers which we resell to the end user. Should you have
any issues or problems with your telephone card, you must contact
the relevant Customer Service Department of each card provider. The
contact numbers are listed on our web site and also sent to you with
your PIN numbers. This should be done immediately when the fault or
issue is first discovered. Card expiration varies by card provider
and details may be found by selecting the card from our home page.
Disclaimer & Warranty
No additional warranties are given or implied,
except by written agreement of Ephonecards. To the extent permitted
by law Ephonecards excludes all conditions and warranties implied in
these Terms of Sale. Ephonecards excludes all liability to you for
any injury, loss or damage (including any indirect or consequential
loss or damage) that you may suffer. For any liability that it
cannot exclude, Ephonecards limits its liability to refunding the
price of the Telephone Card or the supply of another Telephone Card
of the same face value. We offer no warranty for lost or stolen
phone card pins.
